Shosha Koi Terms of Service

These Terms of Service govern your use of the website located at https://shoshakoi.co.uk/ and any related services provided by Shosha Koi.

By accessing https://shoshakoi.co.uk/, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Shosha Koi.

We, Shosha Koi, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Koi for Sale Terms & Conditions

General Koi Purchasing (Excludes New Harvest, Customer Request or Auctions)

- For Koi with a value of £500 and over, you may pay a 50% non-refundable deposit. Koi Under £500 should be paid for in full. 
- Koi purchased on our website/in-store should be collected/or delivered within one month of purchase. Thereafter, £20 per week holding fee applies. - Koi purchased from October 1st may stay over winter at Shosha Koi if needed. We will not be held responsible should the quality declines while in our care. If the Koi dies in our care, you will receive a credit note. Sold koi will typically be kept unheated and with minimal food to ensure optimum water quality. - Over wintered Koi can stay with us till April 6th, 2024. Thereafter £20 per week applies.
 - For Koi that reside with us. If you change your mind on the Koi, you can change it providing the new one is to the same value, or greater. - Genders are not guaranteed, unless specified. e.g. Female Guarantee. If a Female Guarantee Koi is later found to be male, we will require suitable evidence of this. Once satisfied, you will receive a credit note to use. Unfortunately, we can’t offer a refund for this situation, as most breeders now do not guarantee genders. Thus, we are taking the risk. - Under no circumstances can Koi be returned to our premises. This is due to UK governing law and bio security.

New Harvest Koi

- For Koi with a value of £500 and over, you may pay a 50% non-refundable deposit. Koi Under £500 should be paid for in full. - Koi purchased during our Japan trips may stay over winter at Shosha Koi if needed. We will not be held responsible should the quality declines while in our care. If the Koi dies in our care, you will receive a credit note. Sold koi will typically be kept unheated and with minimal food to ensure optimum water quality (once out of quarantine) Koi can stay with us till April 6th, 2024. Thereafter £20 per week applies. All Koi undergo our strict 8-week quarantine procedure, that includes 2 heat ramp cycles as well as necessary parasite treatments. Once out of quarantine, you change your mind on the Koi, you can change it providing the new one is to the same value, or greater. Genders are not guaranteed, unless specified. e.g. Female Guarantee. If a Female guaranteed Koi is later found to be male, we will require suitable evidence of this. Once satisfied, you will receive a credit note to use. Unfortunately, we can’t offer a refund for this situation, as most breeders now do not guarantee genders. Thus, we are taking the risk. Under no circumstances can Koi be returned to our premises. This is due to UK governing law and bio security.

Customer Special Request/Japan Auctions & Events

Due to being on special request basis. Regardless of value, Koi should be paid for in full. (Payment plans can be arranged for those with multiple Koi). Special request Koi are usually Koi we wouldn’t be buying for stock. We will not be held responsible should the quality declines while in our care. Should the Koi die in our care, we will offer a credit note. Sold koi will be typically kept unheated and with minimal food to ensure optimum water quality (once out of quarantine). Koi can stay with us till April 6th, 2024. Thereafter £20 per week applies. All Koi undergo our strict 8-week quarantine procedure, that includes 2 heat ramp cycles as well as necessary parasite treatments. Once out of quarantine, you view the Koi and do not want it. We will treat this on a case-by-case basis depending on the reasoning, and severity of the situation. Do note that as these Koi are purchased on special request, responsibility ought to be with the customer. We are simply here to quarantine the Koi for you. Genders are not guaranteed, unless specified. e.g. Female Guarantee. If a Female guaranteed Koi is later found to be male, we will require suitable evidence of this. Once satisfied, you will receive a credit note to use. Unfortunately, we can’t offer a refund for this situation, as most breeders now do not guarantee genders. Thus we are taking the risk. Under no circumstances can Koi be returned to our premises. This is due to UK governing law and bio security.

Shosha Koi Auction's

You must be registered on our website to use this service, using your full name and correct contact/address details. Bids placed are legally binding and under no circumstances can be withdrawn. Auctions are payable in full within 5 days of auction end. If no payment is received, then your account will be disabled. Auction Koi should be collected/delivered within 1 month of auction end. Thereafter a £20 per week holding fee applies. Auctions won from October 1st may stay over winter at Shosha Koi if needed. We will not be held responsible for quality decline while in our care. Should the Koi die in our care, we will offer a credit note. Sold koi will be typically kept unheated and with minimal food to ensure optimum water quality. If a bid is received in the last 2 minutes of auction end, the auction will extend by a further 2 minutes. This is also known as anti-sniping, a common practice in Japanese Koi auctions. This keeps Users on a fair playing field. Auction Koi cannot be exchanged. By taking part in the auctions, you accept these T&C’s. Should rules be broken, your account will be disabled from taking part in auctions.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
  • remove any copyright or other proprietary notations from any materials and software on this website;
  • transfer the materials to another person or "mirror" the materials on any other server;
  • knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Shosha Koi provides;
  • use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
  • use this website or its associated services in violation of any applicable laws or regulations;
  • use this website in conjunction with sending unauthorised advertising or spam;
  • harvest, collect, or gather user data without the user’s consent; or
  • use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to Shosha Koi and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a licence, not a transfer of title. This licence shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Shosha Koi at any time.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Shosha Koi makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Shosha Koi or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Shosha Koi or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
